Terms of Service

Please note: this is a template policy provided for illustrative purposes during the Porter beta. It must be reviewed and finalised by a qualified solicitor before the platform goes live with paying customers.

1. Agreement

These terms govern your use of the Porter platform. By subscribing to or using Porter, you (“the Agency”) agree to be bound by these terms.

2. Subscription and billing

Porter is offered on a monthly rolling subscription, billed per branch in advance. Pricing is shown on our website and may be updated with 30 days’ notice. All fees are exclusive of VAT, which will be added where applicable.

3. Cancellation

You may cancel your subscription at any time from within your account or by contacting us. Cancellation takes effect at the end of the current billing cycle. We do not offer pro-rata refunds for partial months.

4. Acceptable use

You agree not to:

  • Use Porter for any unlawful or fraudulent purpose
  • Misrepresent property details or pricing
  • Use Porter to discriminate against prospective buyers in breach of the Equality Act 2010
  • Reverse engineer, scrape or attempt to disrupt the service
  • Share account credentials with unauthorised parties

5. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where practicable.

6. Data protection

Each party will comply with its obligations under UK GDPR. Where Porter processes personal data on behalf of the Agency, a Data Processing Agreement forms part of these terms.

7. Liability

To the maximum extent permitted by law, our total liability in any 12 month period is limited to the fees paid by the Agency in that period. We exclude liability for indirect, consequential or loss-of-profit damages. Nothing in these terms limits liability for death, personal injury or fraud.

8. Termination

We may suspend or terminate access for material breach of these terms, with notice where reasonable. Sums due remain payable.

9. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
